Barrett has been somewhat dismissive of the notion of following Supreme Court precedents, the doctrine known as stare decisis. Senator Patrick Leahy is a longtime member of the Senate Judiciary Committee.

Rep. John Curtis, R-Utah, also praised Kavanaugh.

"They know that they will not get a justice nominated if the American people know this is what they want to do", NARAL Pro-Choice America President Ilyse Hogue said in a call with reporters last week.

Kavanaugh has caught a small amount of flack from conservatives for a dissent that helped uphold a key tenet of Obamacare (his minority opinion had nothing to do with the constitutionality of the program-rather he took issue with the court's jurisdiction in the case).

Barrett, 46, is a former law clerk to the late Supreme Court Justice Antonin Scalia.

"That's a big one. and probably not", Trump said.

More than the other potential nominees, Hardiman has a strong record in favor of gun rights. "And so I am pretty, pretty excited", said Cornyn.

Top contenders had included federal appeals judges Raymond Kethledge, Amy Coney Barrett and Thomas Hardiman, as well as Kavanaugh, who is now a federal appellate judge in the District of Columbia.

Hatch said he expects a fight with the Democrats over the nomination will be "vicious".

This year, Kavanaugh authored a dissent to a D.C. Circuit decision to allow a teenaged immigrant to get an abortion, writing that it "is ultimately based on a new constitutional principle as novel as it is wrong: a new right for unlawful immigrant minors in U.S. Government detention to obtain immediate abortion on demand, thereby barring any Government efforts to expeditiously transfer the minors to their immigration sponsors before they make that momentous life decision".

He also has expressed a broad interpretation of what constitutes obstruction of justice, a position which could be risky if the Russian Federation investigation leads to impeachable allegations against Trump.
