Supreme Court rules states can force online retailers to collect sales tax

Today (June 21), the Supreme Court overturned a tax-related 1992 ruling giving states and local governments the ability now to collect possibly billions in internet sales tax from customers. Officials in New Hampshire, which doesn't have a sales tax, say the decision could force its businesses to collect taxes for other states.

"E-commerce has grown into a significant and vibrant part of our national economy against the backdrop of established rules, including the physical-presence rule".

She says prices may go up on her website, but it's important states see tax dollars for online purchases. Consumers were supposed to voluntarily pay sales taxes on remote purchases, although it rarely happened.

"The Trump Store has been a clear victor under what the court just labeled 'a judicially created tax shelter, '" Davis said.

The tax is 6.25 percent.

A new law that goes into effect in January says companies that do at least $250,000 in online business or have at least 200 separate sales purchases must pay sales tax to the state.

The Trump administration supported the Republican initiative saying that the old Supreme Court ruling put traditional retailers at a disadvantage. In Wayfair v. South Dakota, the Court concluded that the "sales tax nexus" previously articulated by the Court in Quill v. "Great victory for consumers and retailers".

North Dakota could collect $20 to $50 million from online retailers after Thursday's Supreme Court ruling.

"Businesses large and small will need to adopt or ramp up their internal processes to meet the challenge of complying with thousands of state and local sales tax jurisdictions", said Richard Jones, an attorney in the Boston office of Sullivan & Worcester.

The court decision could also be important in Florida because of the state's heavy reliance on sales-tax revenue. The 5-4 decision strikes down a 1992 case that restricted states from collecting sales tax from retailers that do not have a physical presence in their state. "We hope that implementation of the sales tax will be done uniformly across state lines to ensure a fair and efficient system of tax collection".
