Madonna loses auction suit after judge rules she waited too long

Yesterday (April 23), Justice Gerald Lebovitz ruled that aside from waiting too long to sue for her belongings back after they'd been out of her possession for so long, under a 2004 kiss-off agreement with Lutz, the "Material Girl" singer forfeited her right to claw back her private items. "Yet before this action began, the plaintiff did not make any demand to return her possessions", reports the NY Daily News. "I never meant to hurt you".

You might recall how back in July of previous year, it was announced that a letter written by Tupac Shakur to Madonna was set to head for auction, with bidding starting at $100,000. While there's little to no evidence of their love affair, there is a break-up letter that Tupac wrote to Madge that's about to hit the auction block despite efforts from Madonna to keep that from happening.

In the letter, the 24-year-old rapper wrote to Madonna, then 37, that a continued interracial relationship would negatively impact his image.

"It's a clear-cut victory for us", Gotta Have It! online auction house co-owner Ed Kosinski told NYDN. I also have a specific memory of reading the letter. She won a temporary stay blocking the auction last summer.

If you've still got your cash saved up from the last time the letter was briefly up for sale, you'll have another chance to put down a bid when the letter goes back up for sale in July. Madonna claimed this woman was a friend who betrayed her trust and privacy by taking the items, but the auction house saw the claims as baseless and were willing to battle it out in court according to Reuters. "And all the high-priced attorneys she hired couldn't change that fact", Jeffrey Haas, an attorney for the auction house added. She recalled the pair becoming friendly in the downtown Manhattan art scene of the early 1980s, and said that she realized early on "that everything that came into contact with Madonna could be important".
