Police won't face charges in Alton Sterling shooting case

Sterling was shot and killed by police outside a convenience store in 2016. For some context, Alton Sterling's death caused a massive surge of Black Lives Matter protests; it wouldn't be surprising to see old wounds reopened. Two use of force experts, Landry said, determined that the officers "acted in a reasonable and justified manner in the shooting death of Mr. Sterling".

However, attorneys L. Chris Stewart and Brandon DeCuir, who represent Alton Sterling's five children, say Landry is to meet beforehand Tuesday morning with relatives of the slain main.

In explaining why it took so long for the state to announce its decision, Landry said Tuesday that his office was "effectively sidelined" during the federal probe because it was closed off to Louisiana officials.

In the Sacramento case, two officers shot at the man, Stephon Clark, 20 times after apparently mistaking his cell phone for a gun, police have said. It also claims poor training and inadequate police procedures led to Sterling's death.

State investigators looked into the case after the U.S. Justice Department announced previous year there wasn't enough evidence to warrant civil rights charges against the two officers. In a summary of its findings, the Justice Department said Salamoni pointed his gun at Sterling's head but didn't mention any verbal threats by the officer. "I am asking that everyone considers the family in the coming days and spend time and energy in lifting them up, rather than creating further division".

The officers were responding to a call about a man with a gun.

Landry said today that Sterling "clearly matched a description" placed provided by a 911 caller, which described a man selling compact discs in front of the food mart.

According to the state report released Tuesday, Sterling refused to heed the officers' commands to put his hands on the hood of a vehicle, and each officer reached for and tried to control Sterling's arms. After learning neither officer would be charged with federal crimes, dozens of people held a peaceful vigil outside the convenience store where Sterling was shot. Based on what the officers were told by dispatch, investigators concluded that Salamoni and Lake acted accordingly.

The officers continue to struggle with Sterling and Landry said Salamoni is heard saying, "He's going for a gun". In one video, an officer draws something from his waistband and points it at Sterling.

That weapon, Landry later said, was a "loaded.38 caliber firearm".

"Both try to get control of Sterling's hands while he continues to resist", the prosecutor said.

Sandra Sterling, Alton Sterling's aunt, said Salamoni took an oath to protect and serve, not "protect and kill".

In May 2017, federal prosecutors found there wasn't enough evidence to warrant civil rights charges against Salamoni and Lake. As a convicted felon, Sterling could not legally carry a gun.

"The Louisiana Department of Justice can not proceed with a prosecution of either Officer Lake or either Officer Salamoni", Landry said.
