They further argued that the sued parties have refused to comply with earlier court orders, which required them to provide him with travel documents to enable his re-entry.

The impasse continued Tuesday morning after Miguna's lawyer Cliff Ombeta said his client will not fill the citizenship forms issued by the Immigration department.

"Explain the circumstances that led to the clobbering of Stephen Letoo, a Citizen Television journalist and Robert Gichira, an NTV Cameraman, at the Jomo Kenyatta International Airport; state the action that will be taken on the police officers who clobbered the journalists and confirm if the government shall compensate the two for the injuries sustained", the nominated Senator said.

Mr Miguna is travelling on his Canadian passport after he was stripped of his Kenyan citizenship.

A heavy contingent of police officers had forcefully placed him into a Dubai-bound flight, but Miguna disembarked the plane and insisted he will not board.

The lawyers want the High Court to issue an order that allows Dr Miguna to remain in the country on the basis of his Kenyan passport as well as his national identity card or a temporary entry permit in lieu of a Kenyan passport.

"There was an attempt to force him onto the plane and he resisted justifiably", said Orengo, who said he witnessed Miguna being "terribly manhandled, pushed and dragged" by plainclothes officers at the airport. Their recent talks have been touted as a way to ease the contention following last year's protracted presidential election cycle, which saw balloting in August and a rerun October 26.

Odinga came to the airport on Monday night to try to intervene on Miguna's behalf and said his Kenyan passport should be returned as a condition for political dialogue, according to Orengo.

Raila visited the airport in a motorcade Monday at about 9:30 p.m., roughly seven hours after Miguna's arrival, to try to obtain Miguna's release.

In a separate incident throwing the spotlight on media freedoms, police punched and kicked journalists covering the attempted deportation of an opposition politician at Nairobi airport on Monday.

Interior ministry spokesman Mwenda Njoka told Reuters on Tuesday he was working on a statement but could not immediately comment.
