Lawfare: Trump Administration Is Going To War Over California's Nonsense Immigration Law

Attorney General Jeff Sessions will speak about ‘sanctuary jurisdiction’ issues at an annual conference organized by California Peace Officers’ Association according to the U.S. Department of Justice

Sessions on Tuesday filed suit against the state over three new laws, passed previous year to protect immigrants living in California illegally, that he argues violate the supremacy clause of the U.S. Constitution and interfere with federal immigration enforcement.

The lawsuit alleges the three laws enacted previous year are "a deliberate effort by California to obstruct the United States' enforcement of federal immigration law".

Federal authorities, including the Immigration and Customs Enforcement and the Customs and Border Protection agencies say the sanctuaries policy allows risky criminal immigrants to go free. The California law does have exceptions in the cases of immigrants who have been convicted of many types of crimes, but the Justice Department lawsuit notes that the superseding federal regulation doesn't make these distinctions.

"This is really unprecedented,"said Brown after Sessions' speech, "for the chief law enforcement officer of the United States to come out to California and act more like Fox News". Orrick rejected a request from the state to place a court-ordered stop to federal policies aimed at punishing sanctuary cities and states, along with other jurisdictions.

Indeed, California lawmakers have been vocal in their support of sanctuary policies, with Oakland Mayor Libby Schaaf recently being forced to defend her decision to warn residents about a number of ICE raids in the area.

Schaaf later echoed the refrain to slam Sessions for tearing apart families and distorting the reality of declining violent crime in a "sanctuary city" like Oakland.

According to the Director of Immigration and Customs Enforcement Thomas Homan, this puts the lives of both officers and American citizens at risk. California Gov. Jerry Brown was already tweeting in response, with a not-so-subtle dig at President Trump's tweeting style. At this point, California has more lawsuits going than you can keep track of without a custom app on your phone.

None of the California policies in question prevent a police department from pursuing or arresting an undocumented immigrant who commits a crime. These three laws, he says, "reflect a deliberate attempt by California to obstruct enforcement of US immigration laws".

It is the first legal action against a state or local government over its immigration policies by Mr Sessions' justice department. Jeff, these political stunts may be the norm in Washington, but they don't work here.

The Department of Justice will unveil the new lawsuit on Wednesday during an event in Sacramento, California. He called it an "embarrassment for the great state of California". "SAD!" Brown is named in the lawsuit along with Democratic Attorney General Xavier Becerra, who said the state is on firm legal footing.

The Supreme Court reinforced the federal government's primacy in enforcing immigration law when it blocked much of Arizona's tough 2010 immigration law on similar grounds.
