Union Cabinet clears bill, makes triple talaq criminal offence

The government, which has backed Muslim women seeking an end to the practice, hopes to get it passed in the Winter Session of Parliament which began Friday.

Under the draft law, triple talaq in any form - spoken, in writing or by electronic means such as email, SMS and WhatsApp - would be bad or illegal and void.

Women's groups such as the Bharatiya Muslim Mahila Andolan (BMMA) welcomed the Union Cabinet's decision to clear a law that would criminalise instant triple talaq even as a meeting of the members of the All India Muslim Personal Law Board (AIMPLB) and senior leaders of the Muslim community will be held on December 17 to formulate a response.

Stating that Muslim women already had a right to seek maintenance from their husbands by virtue of Section 125 of the Code of Criminal Procedure (CrPC), he said when a legislation is made without accounting for awareness to the socio-culture context, it can have potentially disastrous consequences.

Giving instant triple talaq, as per the draft law, will be a non-bailable, cognisable offence. The bill, introduced after Supreme Court's order, would only be applicable to instant triple talaq or "talaq-e-biddat". Muslim scholars and jurists argue that concurrent talaq or triple talaq in one go has never been approved by Prphet Mohammad (peace be upon him), during the tenure of first Caliph Abu Bakr (RA) and the first two years of Caliph Omar's caliphate.

"We also want a codified Muslim family law that would be within the ambit of the Quran and comply with the Constitution of India, somewhat on the lines of the Hindu Code law and the Christian Personal Law that was also reformed with regard to gender equity", she said. It is on this basis, the practice of concurrent talaq has been termed invalid in most of the Muslim countries. Many in the government and opposition have termed it as a progressive bill which fulfills the demands of basic human right for the Indian Muslim women.
