"This man, or this animal, that shot that wonderful, that attractive woman in San Francisco, this guy was pushed back by Mexico", Donald Trump told CNN in July 2015 shortly after announcing his candidacy.

The jury seemed to have been convinced by defense arguments that Garcia-Zarate had no direct intention of firing the.40-caliber Sig Sauer pistol that he found that day on the waterfront, four days after it had been stolen from a U.S. Bureau of Land Management ranger's auto nearby.

The shooting came during the presidential primary campaign in July 2015 and touched off a fierce debate over the country's immigration policies in the presidential race the following year. Before the killing, he had been released from a San Francisco jail after a minor drug charge was dismissed.

Garcia Zarate was charged with murder, assault with a deadly weapon and being a felon in possession of a firearm in the death of Steinle, a 32-year-old Pleasanton native and San Francisco resident, on July 1, 2015.

The shooting, which occurred in a so-called sanctuary city, sparked a national debate about immigration reform.

If Garcia-Zarate had been deported again (he had already been five times) as federal law insisted he should have been (he had been in San Francisco city custody on a warrant regarding fleeing from an old marijuana charge from 1995, moved to them from federal custody for felony illegal re-entry to the U.S.) prior to Steinle's being shot, went the argument, she would still be alive.

None of that, however, has been at issue during the month-long trial.

The jury was handed the case November 21 after the defense wrapped up closing arguments. He said it was wrapped in cloth, and when Garcia Zarate unwrapped it, the gun accidentally discharged.

Known as Kate, she was walking along the pier when she was struck by a bullet and died in her father's arms. Much of the testimony during the trial has focused on ballistics experts.

Defense attorney Matt Gonzalez told jurors the shooting was a tragic accident and that prosecutors were pushing a "wild narrative of a desire to hurt someone he does not know".

But he told jurors that Garcia Zarate had no motivation to kill Steinle and that as terrible as her death was, "nothing you do is going to fix that".

He urged jurors to pick apart the facts of the case, instead of swallowing a ludicrous narrative by the prosecution that relied on circumstantial evidence. "He took the life of a young, vibrant, beautiful, cherished woman by the name of Kate Steinle", she said.

"He knew exactly what he was doing", Garcia said.

Jurors during deliberations considered first-degree murder, second-degree murder and involuntary manslaughter.

The sheriff's department released him a few days later after the district attorney dropped the marijuana charge, despite a USA request to detain him for deportation.
