The mother also points out that she never gave consent for her son, which is required in Fortnite's terms. After this though, Epic went a bit further by suing two cheaters, one of whom is a minor who made a decision to speak out about it on YouTube, and this is where things start getting more interesting and more complicated.

However, the 14-year old's mother has chose to fight the case on his son's behalf and has claimed that Epic Games is using them as scapegoats. "And nobody likes playing with cheaters".

This, along with the fact that the gaming juggernaut is suing a 14 year-old, strongly suggests that Epic had no idea who it was suing.

Epic Games has released Patch v.1.9.1 for Fortnite implementing Xbox One X enhancements for higher visual fidelity, nine new weapons for the game's Save the World portion and non-lethal smoke grenades for Fortnite Battle Royale.

The suit said some of the players publicly boasted about cheating and encouraged others to do the same, a practice that cost Epic lost sales and profits. The company behind the game Fortnite, and much more, has been going after individuals it identifies as cheating in that game with lawsuits.

She also argues that Epic's case is based on loss of profits, but argues that the game is free-to-play, in order for the company to prove a loss they would need to release a statement that showed how the cheating directly caused a "mass profit loss". Second, she says that revealing the identity of her son through the lawsuit is illegal, since he's a minor. First, she claims that her son did not create any modifications for the game himself, and that he actually downloaded existing cheats from a website in public view.

The boy was using cheat software that affected Fortnite Battle Royale, a large multiplayer arena mode added to the game following its release, which was directly inspired by the success of early access PC hit PlayerUnknown's Battlegrounds (PUBG). Additionally, Epic is bringing back Mutant Storms in Save the World, which will reward you with tickets.

Epic had issued a DMCA takedown request for these videos, saying they amount to a guide on how to cheat, and was then promoting it on his YouTube channel. "As we said earlier, we take cheating seriously and will use all possible means to have our games remain fun and fair and supported among gamers, the spirit of competition". Caleb's mom was not having any of that, and in a law-savvy turn of events, she filed a counterclaim in court defending her son against the Fortnite creators.
