SCOTUS to Hear Travel Ban Case, Partially Lifts Injunction

Trump has since revised his order so it will only affect the issuance of new visas to people in Iran, Libya, Somalia, Sudan, Syria and Yemen.

"ASU does not anticipate today's Supreme Court ruling will impact students from the six countries included in the Executive Order, as the ruling specifically states that individuals who have a formal relationship with a university are excluded from the travel ban", Arizona State University President Michael Crow said in a statement Monday. The Court left the preliminary injunction in place to the extent that EO-2 "may not be enforced against foreign nationals who have a credible claim of a bona fide relationship with a person or entity in the United States".

That would include students who have been admitted to a United States school and workers who have accepted an offer of employment from an American company, the court said.

The announcement came in a brief, unsigned opinion issued by the justices when they took the bench this morning to release opinions in cases argued on the merits earlier this term. MESA will continue to act as a plaintiff in that case represented by the ACLU.

America's highest court also granted a White House request allowing part of its refugee ban to go into effect.

Jamal Abdi, policy director for the National Iranian American Council, said most Iranians who visit the United States have relatives here or are coming to work or study.

Because the executive order was stopped by lower courts, travelers from the six countries have been entering the United States by following normal visa procedures. The countries singled out by the Executive Order are all within the Middle East as defined by MESA.

That's no minor exception, according to immigrant groups, who say relatively few people come to the USA from the affected countries without such close ties. International Refugee Assistance Project upholds both the integrity of the judiciary and the Supreme Court's own authority.

This means those with no "bona fide" U.S. ties can be barred from entry if they come from any of the six Muslim-majority countries subject to the ban. He added that the order "allows the travel suspension for the six terror-prone countries and the refugee suspension to become largely effective". Amy Jeffress served as the national security counselor for the attorney general during the Obama administration.

Trump's travel ban remains in legal limbo. The order, if enacted, would suspend the Nation's refugee program for 120 days. But that vetting is done with the assistance of the foreign countries the applicants are traveling from. All the affected countries belong to the bloc.

State Department spokeswoman Heather Nuaert said at a briefing this afternoon that the State Department is waiting for the Department of Justice to give more details on the "bona fide" connection component. This may also affect efforts by many academic institutions to assist scholars at risk through temporary academic appointments.

Stephen Legomsky, chief counsel for U.S. Citizenship and Immigration Services under former President Barack Obama, said lawsuits could claim that a bona fide relationship was ignored.
