Cosby judge could revisit issue of revealing names of jurors

Andrea Constand expressed gratitude to her supporters after a Pennsylvania judge declared a mistrial in the sexual assault trial stemming from her allegations against Bill Cosby. Despite that, he remained sequestered in Montgomery County. Cosby's trial ended without a verdict after jurors failed to reach a unanimous decision.

Television satellite trucks clotted the street in front of the pre-Civil War stone courthouse in Norristown, Pennsylvania, where Cosby's trial was held. Even though the machinations of a retrial would be handled by attorneys, the ultimate decision of the next panel of jurors will be, once again, heavily dependent on their assessment of Constand and Cosby.

Cosby, who turns 80 next month, is accused of drugging and molesting a woman at his home in 2004. "I am eternally grateful for the messages I have received in recent days", Andrea Constand said in a tweet.

The judge will consider whether to release the jurors' names at a hearing on Tuesday. On Saturday, they came back and told O'Neill they were hopelessly deadlocked. Cosby claims their contact was consensual and that the pills he gave her were ordinary Benadryl, though he has admitted on-record that he gave women quaaludes for sex in the 1970s.

Forty-three-year-old Mike McCloskey spoke to Pittsburgh radio station WDVE on Monday.

"At the end of the day I truly believe you're innocent until proven guilty, and that's just not the man that I ever experienced, " the 38-year-old actress said.

Whatever comes next, and the prosecutor has vowed to retry the case, the most important question the trial leaves unanswered is this: When are we going to update our antiquated statutes of limitations - the legal limits that a modern understanding of sexual assault should have forced us to rethink decades ago? Because they fully intend to attempt to re-prosecute Cosby, prosecutors are fighting tooth and nail to keep the identities of the jurors in the first trial hidden. Prosecutors are trying to keep them a secret. However, his reputation had been tarnished over the years as nearly 60 women have come forward and accused him of sexual assault.

Judge O'Neill has ordered the jurors to not speak to the media on why they could not reach a decision after 52 hours of deliberation and a week of testimony. Following a series of complaints against him, he had to face three felony charges of second-degree aggravated indecent assault. "As I said in court, our plan is to move this case forward as soon as possible", District Attorney Kevin R. Steele said at a news conference after a mistrial was declared at Cosby's trial. Judge Steven O'Neill called the Cosby case likely the largest undertaking by the county's criminal justice system.

The AP does not typically identify people who say they are victims of sexual assault unless they grant permission, which Constand has done.
