High court once again upholds death sentence for Ohio woman

Sen. Ted Cruz R-Texas walks from the podium after speaking during the Republican National Convention Wednesday

The U.S. Supreme Court said Tuesday it will take up a challenge to Ohio's system for purging its voter registration lists of residents who don't respond to notices after they fail to vote. He said he was encouraged that the high court was taking up the case.

Husted said he has made maintaining accurate voter rolls a priority in order to increase election integrity and voter confidence, including removing almost 560,000 dead people from the rolls and resolving instances of more than 1.65 million voters who were registered a couple of times.

Under Ohio's procedure, voters who do not vote for two years are sent registration confirmation notices.

"As plaintiffs note", Clay wrote, "the secretary's newly issued form does nothing to correct the fact that OH has, for years, been removing voters from the rolls because they failed to respond to forms that are blatantly non-compliant with the NVRA". Secretary of State Jon Husted is happy about that.

Back in the fall, the 6 Circuit Court of Appeals http://www.opn.ca6.uscourts.gov/opinions.pdf/16a0241p-06.pdf struck down the state's process for clearing ineligible voters, saying it punished inactive voters.

Husted, who is appealing the lower court ruling, announced in early May that he's running for the Republican nomination for governor in 2018, the Dayton Daily News reported.

"Maintaining the integrity of the voter rolls is essential to conducting an election with efficiency and integrity", Husted said in a statement.

Husted said the policy removed almost 560,000 deceased Ohioans from voting rolls since he became Secretary of State, and resolved the cases of more than 1.65 million voters who had multiple registrations.

ACLU of Ohio Legal Director Freda Levenson said the state's policy "served as a powerful mechanism of voter suppression", and she's sure the Supreme Court will uphold the lower court's decision.

OH says 20 other states use a system similar to the challenged one, but civil rights groups say a lot of them are sufficiently different.

The justices will review a US appeals court ruling that Ohio's policy ran afoul of a 1993 law called the National Voter Registration Act, which Congress passed to make it easier for Americans to register to vote. The state has a separate procedure for removing people who file change-of-address forms with the U.S. Post Office.

The justices issued a two-sentence order Tuesday in the redistricting case that challenged 2011 congressional and General Assembly districts. The procedure has prompted years of litigation between the advocates and the Republican-led legislature.

The case, which will be argued in the term that begins in October, is Husted v. A. Philip Randolph Institute. Now the justices told the state Supreme Court to review its previous rulings since justices agreed last week the original 1st and 12th Congressional Districts were illegal.
