ICJ judgement first step in saving Kulbhushan Jadhav: MEA

ICJ to announce verdict on Kulbhushan Jadhav on Thursday

The 11- judge bench of the world court will announce its decision over India's plea against the death sentence awarded to Kulbhushan Jadhav, a former Indian Navy officer.

Replying to a volley of questions on India's possible response if Pakistan does not implement the ICJ order, Baglay said the order is binding on Pakistan.

In its order indicating provisional measures, which was adopted unanimously, the Court also stated that the Government of Pakistan shall inform it of all measures taken in implementation of that Order.

"Court considers it a failure on the part of Pakistan to present counselors to Jhadav", the president said.

In April, a military court sentenced him to death for alleged involvement in spying and subversive activities. "@SushmaSwaraj ji and the entire Hague team", he said in another tweet congratulating External Affairs Minister.

Home minister Rajnath Singh said the ruling gave the people of India a "deep sense of satisfaction and relief".

"The case against Kulbhushan Jadhav by Pakistan was a sham and was in gross violation of global law as his execution was ordered by a kangaroo court without consular access". Kulbhushan Jadhav is a former Naval Officer who went to Pakistan as Spy.

ICJ President Ronny Abraham, a 63-year-old French academic and practitioner in public global law, asked Pakistan to keep the court informed "of all measures taken" in the implementation of the order. On May 09, the global court stayed the death sentence as a provisional measure.

India approached the ICJ on May 8, accusing Pakistan of "egregious violations" of the Vienna Convention in the matter of the detention and trial of Jadhav.

The ICJ on Monday heard the arguments from both India and Pakistan over Kulbhushan Jadhav's case. He said he was praying for a positive verdict at ICJ and was hopeful of his friend's safe return to India.Residents of Aanewadi village in Satara district, where Jadhav owns an acre of land, were elated after the ICJ ruling."This (ICJ ruling) is a good start".

There are three past cases (relating to death penalties) handled by the ICJ that can be seen as some sort of precedent for today's verdict. It argued that provisions of the bilateral treaty "were irrelevant to an assertion of rights of consular access under the Vienna Convention".

Pakistan: Jadhav was captured by the Pakistani military on 3 March 2016 in Balochistan while trying to cross into Pakistan from Iran.

Pakistan stated that a period of 150 days is given in the cases similar to Jadhav's.
