Clinton Email Scandal Embarrasses US State Department, FBI

He said that when Kennedy called him to ask about the email, he repeated the request.

SCOTT PELLEY: We have an update for you on last night's story about State Department pressure on the FBI during its investigation of Clinton's e-mails.

The FBI agent who spoke with State Department official Patrick Kennedy about reclassifying one of Hillary Clinton's emails in exchange for getting agents posted overseas went on the record with the Washington Post and denied that any collusion took place.

That official, whose name is redacted in the documents, relayed to the Federal Bureau of Investigation a conversation between Kennedy and a colleague in the global operations division - presumably McCauley - that was characterized as a "quid pro quo" agreement to change the email's classification status in exchange for allowing the Federal Bureau of Investigation to place more agents in countries where they are now forbidden, according to a summary of the interview.

At that point, Mr. McCauley said, he abandoned any thought of exchanging favors and called Mr. Kennedy immediately to tell him that he could not help.

The FBI said in a statement over the weekend that the FBI never agreed to change the classification on the email, and, "Although there was never a quid pro quo, these allegations were nonetheless referred to the appropriate officials for review".

"Because the subject matter of the email in question was related to arrests overseas, it made total sense for Under Secretary Kennedy to reach out to the Deputy Assistant Director for International Operations who would have had the subject matter expertise as to whether this email needed to be classified", said Toner.

The New York Times reports, McCauley said he remembered Kennedy wanted to redact part of the email on different grounds so it would be "buried in the basement" of the State Department. "I absolutely said emphatically I would not support it", McCauley said. "I need a favor, '" McCauley told the Post.

Kennedy explained that the classified email "caused problems", and he wanted to categorize the document as a B9.

In the end, the email was not declassified. The email was released with a notation that material was classified and redacted because it would reveal confidential sources or information from a foreign government.

Republicans have seized on the quid pro quo claims in recent days with GOP presidential candidate Donald Trump demanding Kennedy be fired. Goodlatte is chairman of the House Committee on the Judiciary. Those who receive classified intelligence should not barter in it - that is reckless behavior with our nation's secrets, ' they wrote in a statement. It had been forwarded to Clinton's private email address by Jake Sullivan, one of her top aides and the department's director of policy planning, who was using his government email account. State Department knew it, Patrick Kennedy knew it, and yet they continue to fight it.

Kennedy's request came in the midst of an intense debate within U.S. intelligence agencies over what information found on Clinton's private server should be deemed classified.

Though interagency contacts are frequent for records issues, Kennedy's broad portfolio would generally preclude him from getting involved in mundane questions of security classification, experts said.
